Introduction
These Terms of Use (“Terms”) govern your access to and use of Scape (the “Service”) and the scape website and dashboard (collectively, the “Site”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
The Service is provided solely for business and professional use to help users discover and enrich public business information for lead generation and related outreach. You are responsible for ensuring that your use of the Service complies with all applicable laws, including any marketing, privacy, and anti‑spam regulations in your jurisdiction.
You may not misuse the Service, attempt to interfere with its normal operation, or use it in any way that could harm Scape, other users, or third parties. Scape may update or modify these Terms from time to time by posting a revised version on the Site; your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Fair Use
You may use the Service only for lawful business purposes and in accordance with these Terms. You agree not to:

Use the Service to target or collect information about private individuals, or for consumer data brokering.

Use exported data to send spam or any communications that violate applicable anti‑spam, privacy, or marketing laws.

Access, search, or use the Service by any means other than our publicly supported interfaces, or attempt to bypass usage limits or security controls.

Copy, resell, sublicense, or otherwise provide access to the Service to any third party without Scape’s prior written consent.

Reverse engineer, modify, or create derivative works based on the Service, or attempt to gain unauthorized access to any part of the infrastructure.
Scape reserves the right to suspend or terminate your account immediately if it reasonably believes you have violated this Fair Use section.
Accounts, Access, and Security
To use certain features of the Service, you may need to create an account with a valid email address and password. You agree to provide accurate, current information and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, you must notify Scape promptly so access can be suspended or reset.
Scape may, in its sole discretion, suspend or restrict access to the Service (including specific searches or features) if it detects unusual activity, suspects abuse, or needs to protect the security and stability of the platform.
Fees, Payments, and Credits
Certain features of the Service are provided on a paid basis (“Paid Plans”). By choosing a Paid Plan, you agree to pay all applicable fees described at the time of purchase. Prices, features, and limits for each plan may change from time to time, but any changes will not apply retroactively to already‑paid periods.​
Payments are processed by third‑party providers such as Razorpay. You authorize Scape and its payment processors to charge your selected payment method for subscription fees, taxes, and any other charges associated with your account. All fees are non‑refundable except where required by applicable law.​
Scape may offer usage‑based limits (for example, a number of searches, exports, or verifications) as part of each plan. Scape may suspend or restrict access if you exceed your plan limits or fail to pay fees when due, until payment is made or your usage is brought back within plan limits.
Data, Accuracy, and Your Responsibilities
The Service discovers and enriches business information from publicly available sources and third‑party providers. Scape does not create or control this underlying data and cannot guarantee that any particular record, email address, or phone number is complete, current, or error‑free. You understand that some data may be outdated, incomplete, or later change at the source.​
You are solely responsible for how you use any data exported from the Service, including any outreach or marketing activities you conduct. You must ensure that your use of such data complies with all applicable laws and regulations, including privacy, anti‑spam, telemarketing, and data protection rules in the jurisdictions where you and your contacts are located. Scape is not responsible for your compliance with these obligations.
Disclaimers and Limitation of Liability
The Service, including all data, features, and documentation, is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Scape disclaims all warranties of any kind, whether express or implied, including any implied warranties of accuracy, merchantability, fitness for a particular purpose, and non‑infringement. Scape does not warrant that the Service will be uninterrupted, error‑free, or free of harmful components.​
To the maximum extent permitted by law, Scape and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service. In all cases, Scape’s total aggregate liability for any claim relating to the Service will be limited to the greater of (a) the amount you paid to Scape for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 10,000.​
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.​
Terminations
Scape may suspend or terminate your access to the Service at any time if you materially breach these Terms, misuse the Service, or if continued access would create risk or legal exposure for Scape. You may stop using the Service at any time and may request account closure by contacting Scape.
Upon termination, your right to access the Service will end immediately, but certain provisions of these Terms that by their nature should survive (such as limitations of liability and disclaimers) will continue to apply.
General
These Terms are governed by the laws of India, without regard to conflict‑of‑law principles. Any disputes arising out of or relating to the Service will be subject to the exclusive jurisdiction of the courts located in your chosen city/state (for example, Bengaluru, Karnataka or Mumbai, Maharashtra) and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Scape’s failure to enforce any right or provision is not a waiver of that right. You may not assign or transfer these Terms without Scape’s consent.
